Inexerciseofthepowersconferredbysection16andsubsections202(2)and204(2)oftheCommunicationsandMultimediaAct1998[Act588],theMinister
makesthefollowingregulations:
Citationandcommencement
1.(1)TheseregulationsmaybecitedastheCommunicationsandMultimedia(UniversalServiceProvision)(Amendment)Regulations2008.
(2)TheseRegulationscomeintooperationon1August2008.
Amendmentofregulation2
2.TheCommunicationsandMultimedia(UniversalServiceProvision)Regulations2002[P.U.(A)419/2002],whicharereferredtoas“theprincipalRegulations”
intheseRegulations,areamendedinregulation2—
(a)inthedefinitionof“grossrevenue”,bysubstitutingfortheword“received”theword“receivable”;
(b)inthedefinitionof“nationalpenetrationrate”,byinsertingaftertheword“national”theword“PSTN”;
(c)inthedefinitionof“area”,byinsertingafterthewords“NationalLandCode1965[Act56/1965]”thewords“andincludesa
combinationofdistrictsorpartofadistrict”;
(d)byinsertingafterthedefinitionof“grossrevenue”thefollowingdefinition:
‘“nationalbroadbandpenetrationrate”meansthepercentageofthetotalnumberofbroadbandsubscribersinMalaysiadividedbythetotal
populationasprojectedbasedonthelatestMalaysianPopulationandHousingCensusconductedbytheStatisticsDepartment;’;
(e)bysubstitutingforthedefinitionof“underservedarea”thefollowingdefinition:
‘“underservedarea”means—
(a)inrelationtoPSTNservices,anyareawherethepenetrationrateforPSTNsubscribersinMalaysiaistwentypercentbelowthe
nationalPSTNpenetrationrateorwherethePSTNservicesarenotsufficientlyavailableasprovidedunderregulation3a;
(b)inrelationtobroadbandaccessservices,anyareawherethepenetrationrateforbroadbandsubscribersinMalaysiaisbelow
thenationalbroadbandpenetrationrateorwherebroadbandaccessservicesarenotsufficientlyavailableasprovidedunder
regulation3a;or
(c)inrelationtopubliccellularservices,anyareawithapopulationdensityofeightypersonspersquarekilometreorlessorwherepublic
cellularservicesarenotsufficientlyavailableasprovidedunderregulation3a;’;

3.Regulation3oftheprincipalRegulationsisamended—
(a)insubregulation(1),bysubstitutingforparagraphs(a)and(b)thefollowingparagraphs:
“(a)theinstallationofnetworkfacilitiesandtheprovisionofnetworkservices;and
(b)theprovisionofapplicationsservicesfor—
(i)providingcollectiveaccesstobasictelephonyserviceandInternetaccessservice;and
(ii)providingindividualaccesstobasictelephonyserviceandInternetaccessservice.”;and
(b)byinsertingaftersubregulation(2),thefollowingsubregulations:
“(3)TheCommissionmaycombineanynumberofunderservedareasorpartsofanunderservedareafortheprovisionofnetworkfacilities,
networkservicesorapplicationsservicestomeettheuniversalserviceprovisionobjectives.
(4)Forthepurposesofsubregulation3(3),underservedareameansanyareawhereintheopinionoftheCommissionnetworkfacilities,network
services,applicationsservices,networkfacilitiesandnetworkservices,arenotsufficientlyavailable.”.

4.TheprincipalRegulationsareamendedbyinsertingafterregulation3thefollowingregulation:
“Commissionmaydecide
3a.TheCommissionmaydecidewhetherornotPSTNservices,broadbandaccessservicesorpublictelephonycellularservicesaresufficiently
availableinanareabasedonanycriteriaasmaybedeterminedbytheCommission.”.

(a)byinsertingafterparagraph(b)thefollowingnewparagraph:
“(ba)whereapplicable,theminimumspeedforthebroadbandaccessservicesasmaybedeterminedbytheCommission;”;

approveduniversalserviceplanunlessthedesignateduniversalserviceproviderhasreimbursedtheCommission—
(a)overpaidmoniesunderregulation21a;
(b)anypaymentsdueunderparagraph6(b);
(c)allcostsincurredinrestoringservicesintheuniversalservicetarget;and

Mattersforconsiderationforapprovingdraftofuniversalserviceplan
36.(1)TheCommissionshallconsiderthefollowingbeforeapprovingthedraftoftheuniversalserviceplanunderregulation36e:
(a)whethersuchdraftoftheuniversalserviceplancoversmattersrequestedundersubregulation36(2);
(b)whethersuchdraftoftheuniversalserviceplanisefficientandeconomicallypracticable;
(c)whethersuchdraftoftheuniversalserviceplancanbeimplementedprogressivelythroughoutthatuniversalservicetargetwithinsuchperiodasthe
Commissionconsidersreasonable;
(d)whethersuchdraftoftheuniversalserviceplanwillcontributetowardsmeetingtheobjectivesofuniversalserviceprovision;and
(e)suchothermattersastheCommissiondeemsrelevant.
(2)TheCommissionmay,atanytimebeforeapprovingthedraftoftheuniversalserviceplan,requestthemajorcontributortoprovidesuchfurther
informationorotherdocumentswithinthetimespecifiedintherequestoranyextensionoftimegrantedbytheCommission.
(3)TheCommissionshalltakeintoconsiderationsuchfurtherinformationorotherdocumentsprovidedbythemajorcontributorbeforeapprovingthedraft
oftheuniversalserviceplan.
PoweroftheCommissionoverdraftofuniversalserviceplan
36.(1)TheCommissionaftertakingintoconsiderationthedraftoftheuniversalserviceplansubmittedbyanymajorcontributor,may—
(a)approvethedraftoftheuniversalserviceplanwithoutamendments;
(b)approvethedraftoftheuniversalserviceplanwithamendments;or
(c)rejectthedraftoftheuniversalserviceplan.
(2)Forthepurposeofconsideringthedraftoftheuniversalserviceplanundersubregulation(1)(a)or(b),theCommissionmay,bynoticeinwriting,direct
themajorcontributortoprovideanyfurtherinformationandtomakeanychangestothedraftoftheuniversalserviceplan.
(3)Theapproveddraftoftheuniversalserviceplanunderparagraph(1)(a)or(1)(b)shallconstituteanapproveduniversalserviceplanforthepurposeof
theimplementationofuniversalserviceprovision.
Notificationofapprovalofuniversalserviceplananddesignationofmajorcontributorasuniversalserviceprovider
36.(1)IftheCommissionapprovesthedraftoftheuniversalserviceplaninaccordancewithparagraph36e(1)(a)or(b),theCommissionshallnotifythemajor
contributorinwritingofitsdecisionandshalldesignatethelicenseeasthedesignateduniversalserviceproviderfortheuniversalservicetarget.
(2)Thenotificationanddesignationundersubregulation(1)shallincludethefollowing:
(a)thecommencementdatefortheimplementationoftheapproveduniversalserviceplan;
(b)theapproveduniversalserviceplanincludingthecostsandexpenseswhichwouldbepaidfromtheUSPFund;
(c)thescheduleforpaymentandthetimelineforcompletionofthedeliverables;
(d)thecompletiondatefortheimplementationoftheapproveduniversalserviceplan;
(e)thefinaldateforthesubmissionofclaims;and
(f)suchothermattersastheCommissionconsidersrelevant.
Utilisationofcontributionofmajorcontributor
36.Ifanyuniversalserviceplanapprovedunderregulation36edoesnotfullyutilisethecontributionspecifiedundersubregulation36b(1),anysurplusofthe
contributionnotutilisedshallbeusedfortheimplementationoftheapproveduniversalserviceplansunderregulation8.

Separateaccountforimplementationofuniversalserviceplan
36.TheCommissionmayrequirethemajorcontributortomaintainaseparateaccountfortheimplementationoftheuniversalserviceplan.
Claimsforpaymentbymajorcontributor
36.(1)ThedesignateduniversalserviceprovidershallsubmitawrittenclaimtotheCommissionforthecapitalcostofuniversalserviceprovisioninaparticular
universalservicetargetfortheimplementationofuniversalservice.
(2)Aclaimforpaymentundersubregulation(1)shallbeinaccordancewiththeprovisionsofpaymentintheapproveduniversalserviceplanandshallbe
accompaniedbyanysuchdocumentwhichtheCommissionmayrequire.
(3)Ifnoclaimismadeonorbeforethefinaldateforthesubmissionofclaimsasstipulatedinthenotificationundersubregulation36f(2),nopaymentshall
bedueorpayabletothedesignateduniversalserviceproviderinrespectoftheimplementationoftheapproveduniversalserviceplan.
Commissiontoverifyclaimforpayment
36.(1)TheCommissionshallverifyanyclaimmadebyadesignateduniversalserviceproviderbeforepaymentismadefromtheUSPFund.
(2)TheCommissionmay,atanytime,forthepurposesofverifyingaclaimundersubregulation(1),requestthedesignateduniversalserviceproviderto
provideanyfurtherinformationorotherdocumentswithinthetimespecifiedintherequestoranyextensionoftimegrantedbytheCommission.
(3)TheCommissionshalltakeintoconsiderationsuchfurtherinformationorotherdocumentsprovidedbythedesignateduniversalserviceproviderin
verifyingtheclaim.
(4)Ifsuchfurtherinformationorotherdocumentsrequiredundersubregulation(2)isnotprovidedbythedesignateduniversalserviceproviderwithinthetime
specifiedintherequestoranyextensionoftimegrantedbytheCommission,theCommissionmayverifytheclaimandtheverificationoftheCommissionshall
befinal.
Paymentofclaimtomajorcontributors
36.(1)Paymentforthecapitalcostsincurredinimplementingtheapproveduniversalserviceplanpursuanttoregulation36inauniversalservicetargetshall
bemadeuponadulyverifiedclaimunderregulation36jnotlaterthanthirtydaysfromthedatetheverificationiscompletedbytheCommission.
(2)Notwithstandingsubregulation(1),theCommissionmay,initsabsolutediscretion,makeinterimpaymentofanyamountclaimedpendingthe
verificationoftheclaim.
Overstatementofclaim
36.(1)IftheCommissionfindsthatadesignateduniversalserviceproviderhasoverstateditsclaiminrespectofthecostincurredinimplementingtheapproved
universalserviceplaininauniversalservicetargetforacalendaryear,theCommissionmay,byawrittennoticetothedesignateduniversalserviceprovider—
(a)statetheCommission’sfindings;and
(b)requestthedesignateduniversalserviceprovidertoexplaininwritingtheoverstatementwithinaspecifiedperiodoftime.
(2)Iftheexplanationasrequestedunderparagraph(1)(b)isnotprovidedbythedesignateduniversalserviceproviderwithinthetimespecifiedinthe
requestoranyextensionoftimegrantedbytheCommission,theCommissionmaymakeadecisionontheclaimofandthedecisionoftheCommissionshallbe
final.
(3)TheCommissionshall,beforemakingadecisionundersubregulation(2),considerthefollowing:
(a)theexplanationprovidedbythedesignateduniversalserviceprovider,ifany;
